This Privacy Policy describes how J. Peter Capital, LLC collects, uses, and discloses your information when you use the QuietMoneyFX website and service, and explains your privacy rights. By using the Service, you agree to the collection and use of information as described here.
DEFINITIONS
Company (referred to as "the Company", "We", "Us", or "Our") refers to J. Peter Capital, LLC, 2055 Limestone Road, 200D, Wilmington, DE 19808, United States.
Website refers to quietmoneyfx.com and any related pages we operate, including jpetercapital.com.
Service refers to the Website and the QuietMoneyFX subscription, under which trades placed by the Company's tracked strategy are replicated to your brokerage account by copy-trading software.
Broker refers to the third-party brokerage firm that holds your trading account. The Company is not your broker and never holds your funds.
Copy-Trading Platform refers to Social Trader Tools, the third-party web-based service that maintains the connection between the tracked account and your brokerage account and executes the replicated trades.
Service Provider means any third party that processes data on the Company's behalf to provide, support, or analyze the Service.
Personal Data is any information that relates to an identified or identifiable individual.
Usage Data is information collected automatically when you use the Website, such as your IP address, browser type, pages visited, and time spent on those pages.
Account means the QuietMoneyFX subscription account you create with us.
You means the individual accessing or using the Service, or the legal entity on whose behalf that individual acts.
INFORMATION WE COLLECT
Information you provide to us
- Contact and account details: your name, email address, and, if you provide it, your phone number and mailing address.
- Payment details: your subscription is billed through Stripe. Your card number is transmitted directly to and stored by Stripe. We receive confirmation of payment, the card type, and the last four digits, but never your full card number.
- Brokerage connection details: to connect your account to the tracked strategy, you provide your Broker's name, your trading account number, the Broker's server, and the account password that permits trading. A read-only investor password is not sufficient, because trades must be placed in your account. These details are entered into and held by the Copy-Trading Platform. See "Brokerage Credentials" below.
- Correspondence: anything you send us by email or through the contact form.
Information collected automatically
When you visit the Website we collect Usage Data, including your device's IP address, browser type and version, the pages you visit, the date, time, and duration of your visit, and similar diagnostic data. When you access the Website from a mobile device, this may include the device type, operating system, and mobile browser.
BROKERAGE CREDENTIALS
Brokerage connection details are used for one purpose only: to allow the Copy-Trading Platform to replicate the tracked strategy's trades in your account. They are not used for any other purpose and are not shared with any party other than the Copy-Trading Platform.
The Company cannot withdraw funds from your account, change your account's ownership, or access your Broker's cashier. Your funds remain at your Broker, in your name, at all times.
Social Trader Tools hosts connected accounts on its own servers and is responsible for the security of credentials held there. Its handling of your data is governed by its own privacy policy, available at socialtradertools.com.
You can revoke the connection at any time by disconnecting your account through the Copy-Trading Platform, by changing the password at your Broker, or by asking us in writing. When your subscription ends, we disconnect your account and remove your connection details from the Copy-Trading Platform.
We recommend using a dedicated trading account for the Service rather than an account that holds unrelated funds.
COOKIES AND TRACKING
The Website uses only the cookies it needs to function and to remember choices such as cookie acceptance. The Website is hosted on GoDaddy, which may set its own operational cookies. We do not use advertising cookies, tracking pixels, or third-party analytics. You can instruct your browser to refuse cookies or to alert you when a cookie is being sent; some parts of the Website may not work correctly without them.
HOW WE USE YOUR INFORMATION
We use Personal Data to:
- Provide and maintain the Service, including connecting your brokerage account to the tracked strategy.
- Manage your Account and subscription, including billing, renewals, and cancellation.
- Contact you about the Service: setup instructions, account notices, changes to the Service, and responses to your requests.
- Send you information about the Service and related updates. You may opt out of non-essential emails at any time using the link in each message or by contacting us.
- Understand how the Website is used so we can improve it.
- Comply with legal obligations, resolve disputes, and enforce our agreements.
- Evaluate or complete a merger, sale, restructuring, or other transfer of some or all of our business, in which Personal Data may be among the assets transferred.
We do not sell your Personal Data, and we do not share it for advertising.
HOW WE SHARE YOUR INFORMATION
We share Personal Data only as follows:
- With Service Providers who process data on our behalf: Social Trader Tools (copy-trading platform), Stripe (payment processing), and GoDaddy (website hosting and email). Each is permitted to use your data only to perform services for us.
- With FX Blue, the third-party service that records and publishes the tracked account's trading results. FX Blue receives data about the tracked account only; it does not receive your Personal Data or data about your account.
- With your Broker, only to the extent required to establish and maintain the copy-trading connection you have requested.
- When required by law, such as in response to a subpoena, court order, or lawful request by a public authority.
- To protect our rights, property, or safety, or that of our users or the public, or to investigate possible wrongdoing in connection with the Service.
- In connection with a business transfer, as described above. We will notify you before your Personal Data becomes subject to a different privacy policy.
- With your consent, for any other purpose you approve.
RETENTION
We keep Personal Data only as long as needed for the purposes described in this policy. Account and billing records are retained for as long as your Account is active and for seven years afterward to meet tax, accounting, and legal obligations. Brokerage connection details are removed from the Copy-Trading Platform when your connection is ended. Usage Data is generally retained for a shorter period unless needed for security or legal reasons.
SECURITY
We use commercially reasonable measures to protect your Personal Data, and we rely on Service Providers that do the same. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
INTERNATIONAL TRANSFERS
The Service is available to subscribers worldwide. Personal Data is processed in the United States and wherever our Service Providers operate. If you access the Service from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. Where required, we rely on appropriate safeguards for such transfers, and by using the Service you consent to this transfer.
YOUR RIGHTS AND CHOICES
You may request access to, correction of, or deletion of your Personal Data at any time by contacting us at the address below. You may opt out of non-essential emails using the unsubscribe link in any message. You may disconnect your brokerage account and cancel your subscription at any time.
Residents of the European Economic Area, the United Kingdom, and Switzerland have rights under the GDPR, the UK GDPR, and Swiss data protection law, including the rights of access, rectification, erasure, restriction, portability, and objection, and the right to lodge a complaint with a supervisory authority. Our legal bases for processing are performance of our contract with you, our legitimate interests in operating and improving the Service, compliance with legal obligations, and your consent where required.
Residents of U.S. states with consumer privacy laws, including California, may have the right to know what Personal Data we hold about them, to request its deletion or correction, and to not be discriminated against for exercising those rights. We do not sell Personal Data and do not share it for cross-context behavioral advertising.
We honor all such requests as required by the law that applies to you. To exercise any right, contact us at the address below. We may ask you to verify your identity before acting on a request.
CHILDREN
The Service is intended for adults. We do not knowingly collect Personal Data from anyone under 18. If you believe a minor has provided us with Personal Data, contact us and we will delete it.
LINKS TO OTHER WEBSITES
The Website contains links to third-party sites, including FX Blue, your Broker, and Social Trader Tools. We do not control those sites and are not responsible for their content or privacy practices. Review their policies before providing information to them.
CHANGES TO THIS POLICY
We may update this Privacy Policy from time to time. We will post the revised policy on this page and update the "Last updated" date. For material changes, we will notify subscribers by email before the change takes effect. Continued use of the Service after a change takes effect means you accept the revised policy.
